End User License Agreement (EULA)

YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS BEFORE USING THIS PRODUCT.

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND 3DGDA.COM.
IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, YOU SHOULD NOT USE THIS PRODUCT.
BY PURCHASING, DOWNLOADING, COPYING, OR OTHERWISE USING THE PRODUCT,
YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU SHOULD NOT USE THIS PRODUCT.


End User License Terms:

1. SOFTWARE LICENSE:

With the purchase of this product you get the license to use its assets in modified or unmodified forms for your computer game, virtual world,  simulation,renderings or animation projects.
The license is not limited to a single project but it is intended for the sole use of the purchaser who may not resell, transfer, distribute, give or sublet the license.

2. OWNERSHIP:

- This product and all of its content is proprietary material of 3DGDA.COM
- This product and all of the assets of this product including, but not limited to, all models, textures and any derivative works thereof, may not be resold or re-distributed individually or as a package offering in any format outside of the project work of the initial purchaser as described in section 1 “SOFTWARE LICENSE” without the prior written permission of 3DGA.COM.


3. TERMINATION OF THIS LICENSE:

3DGDA.COM may terminate this license at any time if you are in breach of the terms and conditions of use. Upon such termination you agree to immediately destroy all copies of this product, any derivative works of the product and all of its accompanying documentation.

4. DISCLAIMER AND WARRANTY:

3DGDA.COM  provides the products related to this agreement "AS IS" without warranty, expressed or implied. 3DGA.COM is in noway responsible for the functionality or marketability of the product and the purchaser agrees to assume total responsibility and risk in regards to the use of this product.

5. CHOICE OF LAW:

This agreement will be governed by the laws of the State of Washington, U.S.A., excluding its conflict of law provisions.
Unless otherwise agreed in writing, all disputes relating to this Agreement shall be subject to final and binding arbitration in King County, Bellevue, with the losing party paying all costs of arbitration.
